The ruling came after Jaffe twice failed to appear forscheduled testimony this month despite being subpoenaed. "We are going to evaluate today's ruling and areconsidering an appeal in this very important issue offundamental law," Stanley Arkin, a lawyer representing Jaffe,said in a statement. Jaffe, a Massachusetts native with roots in Bostonfinancial circles, has said he is as much a victim of Madoff'salleged $50 billion fraud as anyone else.
